This website (pay-kova.store) and our main storefront at kovaeu.com are both operated by KOVA Ltd, a company registered in England & Wales (Company Number 15847291) with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom. Our VAT registration number is GB445827193. pay-kova.store is our dedicated checkout domain — orders placed here are part of the same KOVA Ltd entity.

Throughout these Terms, "KOVA", "we", "us" and "our" refer to KOVA Ltd. "You" and "your" refer to the visitor or customer using our website.

2. Acceptance of Terms

By accessing and using the KOVA website, placing an order, or creating an account, you agree to be bound by these Terms & Conditions and all applicable UK laws and regulations. If you do not agree with any part of these terms, you must not use this website.

We reserve the right to update or modify these Terms at any time without prior notice. The latest version is always available on this page, dated at the top. Your continued use of the website following any changes constitutes acceptance of those changes. For active orders, the version of the Terms in effect at the time of purchase will apply.

3. Use of the Website

You may use our website for lawful purposes only. You agree not to use the site in any way that could damage, disable, or impair the website, or interfere with any other party's use of the site. You may not attempt to gain unauthorised access to any part of the website, other user accounts, or any systems or networks connected to our servers.

You must be at least 16 years of age to use this website. By using KOVA, you represent and warrant that you meet this age requirement. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

4. Products and Pricing

We make every effort to display our products and their colours as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual colours, textures or details. Product images are for illustrative purposes and may differ slightly from the actual item due to monitor calibration, lighting or fabric variation.

All prices are displayed in the currency selected via our currency switcher (GBP, EUR or USD) and include all applicable VAT and import duties for UK and EU customers (DDP shipping). For non-EU destinations, local customs duties may apply on arrival and are the responsibility of the recipient.

We reserve the right to change prices at any time without prior notice. Once an order is placed, the price you paid is final. In the event of an obvious pricing error (e.g. a £100 item priced at £1), we reserve the right to cancel the order and refund you in full.

5. Orders, Contract Formation and Payment

When you place an order through KOVA, you are making an offer to purchase the selected products. The order confirmation email we send acknowledges receipt of your order but does not constitute acceptance. The contract between you and KOVA is formed only when we dispatch the goods to you.

We reserve the right to decline any order at our discretion, including (but not limited to) cases of: product unavailability, errors in pricing or product information, suspected fraudulent activity, or shipping address restrictions. If we decline your order, we will refund any payment made in full.

Payment must be made at the time of purchase. We accept Visa, Mastercard, American Express, Apple Pay, Google Pay and PayPal. All payments are processed securely by our PCI-DSS Level 1 compliant payment partner (Whop). KOVA does not see, store or have access to your full card details.

6. Shipping and Delivery

We ship to 23 countries from our Portuguese warehouse. Standard delivery times: UK 4-6 business days, EU 5-7 business days, US 7-10 business days, rest of world 10-14 business days. Delivery times are estimates only and not guaranteed.

All orders ship via tracked courier. You will receive a tracking number by email when your parcel is dispatched. We are not liable for delays caused by customs clearance, extreme weather, courier disruptions, or events outside our reasonable control.

Risk of loss and title for purchased items pass to you upon delivery to the address provided at checkout. If your order is lost or damaged in transit, please contact orders@kovaeu.com within 14 days of the expected delivery date so we can investigate with the courier and arrange a replacement or refund.

7. Right of Cancellation & Returns

Under the UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive, you have the right to cancel your order within 14 days of receiving the goods, without giving a reason. KOVA voluntarily extends this period to 30 days from delivery for all customers.

To exercise your right of cancellation, contact orders@kovaeu.com with your order number. Items must be returned unworn, unwashed, and in their original condition with all tags attached. We will provide a prepaid return label at no cost to you.

Refunds are issued to your original payment method within 5-10 business days of us receiving and inspecting the returned items. Refunds include the original shipping cost where applicable. For full details, see our Returns & Refunds policy.

8. Statutory Rights (UK Consumer Rights Act 2015)

For UK customers, the Consumer Rights Act 2015 provides that goods must be of satisfactory quality, fit for purpose, and as described. If a product you receive from KOVA does not meet these standards, you are entitled to a repair, replacement, refund, or partial refund as appropriate, in addition to any rights under our voluntary 30-day return policy.

Nothing in these Terms limits or excludes your statutory rights as a consumer. If you believe a product is defective, please contact orders@kovaeu.com with photos and a description of the issue.

9. Intellectual Property

All content on this website — including text, graphics, logos, images, product descriptions, photography, video, and software — is the property of KOVA Ltd or its licensors and is protected by UK and international copyright, trademark and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website without our prior written consent. The "KOVA" name, logo, and all related trademarks are the exclusive property of KOVA Ltd.

10. Limitation of Liability

To the fullest extent permitted by law, KOVA Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of profits, data, business opportunity, or other intangible losses — arising from your use of or inability to use our website or services.

Our total liability to you for any claim arising from or related to your purchase of a product shall not exceed the amount you paid for that specific product. Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under UK law.

11. Privacy and Data Protection

We collect, use and store personal data in accordance with the UK GDPR and the Data Protection Act 2018. By using this website, you consent to our processing of your personal data as described in the Privacy Policy.

12. Governing Law and Jurisdiction

These Terms & Conditions and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England & Wales.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales, except that consumers resident in the EU may also bring claims in their country of residence under EU consumer law. EU consumers may also use the European Commission's Online Dispute Resolution platform.
